Barney Frank and his team have been working relentlessly to overturn the UIGEA all through 2009. Their concerted efforts however, are yet to pay off and the issue of online gambling is now due to be resolved by June 2010. While the congress is bogged down over issues relating to health care and financial reform, the online gaming issue has again been put on the back burner. The Congress was due to resolve the issue on regulating online gambling in the US by 2009 or by the fall of 2010. Since the decision is getting invariably delayed impatient state lawmakers are forced to introduce intrastate laws, rather than through national improvement.

New Jersey has already taken the lead and has started considering a bill that will permit Atlantic City casinos to operate online gambling, provided they serve inside state borders. California had taken positive steps towards legislation, but the tribal casinos have disallowed passage thus far. Florida is studying the potential revenues that could come out of regulating online gaming, and Pennsylvania and Delaware have indicated that they will consider any gambling extension that will prove beneficial to the state.

Chairman of iMEGA, Joe Brennan categorically stated, if New Jersey were successful in regulating online gaming and online casino games, it would be a matter of time before Pennsylvania, Delaware, Connecticut, New York and some other states follow suit.

In this scenario, foreign operators who are keen to bring their online gambling sites to the US would be pleased to see a national solution to this issue, but are prepared to make do within the framework legislators provide them with. Many online casinos are looking to either base US operations as B2B (Business to Business), or to set up software, which can be easily adapted to varying rules and regulations in force from time to time.
